1.1. Niniejszy Regulamin okre\u015bla zasady korzystania z us\u0142ug PLAYGROUND, w tym zak\u0142adania konta, zakupu karnet\u00f3w i cz\u0142onkostw, dokonywania rezerwacji oraz udzia\u0142u w zaj\u0119ciach prowadzonych w Studiu.<\/span><\/p>

1.2. Us\u0142ugi \u015bwiadczone s\u0105 przez Playground Wellness Sp. z o.o. pod nazw\u0105\u00a0 PLAYGROUND Reformer Pilates Studio.<\/span><\/p>

1.3. Regulamin jest udost\u0119pniany nieodp\u0142atnie w Serwisie w spos\u00f3b umo\u017cliwiaj\u0105cy jego zapisanie i odtworzenie. Klient powinien zapozna\u0107 si\u0119 z Regulaminem przed dokonaniem zakupu lub rezerwacji.<\/span><\/p>

1.4. Do zawarcia umowy online dochodzi po wybraniu us\u0142ugi, dokonaniu wymaganej p\u0142atno\u015bci oraz otrzymaniu potwierdzenia zakupu w Serwisie.<\/span><\/p>

4.2. Klient powinien podawa\u0107 dane prawdziwe, kompletne i aktualne oraz chroni\u0107 dane dost\u0119powe do konta przed osobami trzecimi.<\/span><\/p>

4.3. Konto, Karnet, Cz\u0142onkostwo i rezerwacje maj\u0105 charakter osobisty. Nie mog\u0105 by\u0107 udost\u0119pniane, przenoszone, odsprzedawane ani wykorzystywane przez inn\u0105 osob\u0119, chyba \u017ce PLAYGROUND wyra\u017anie postanowi inaczej w opisie konkretnej oferty.<\/span><\/p>

4.4. Rezerwacji mo\u017cna dokonywa\u0107 wy\u0142\u0105cznie dla w\u0142a\u015bciciela konta.<\/span><\/p>

5. Zakup i p\u0142atno\u015bci<\/b><\/p>

5.1. Aktualne rodzaje us\u0142ug, ceny, okresy wa\u017cno\u015bci i liczba Wej\u015b\u0107 s\u0105 prezentowane w Serwisie. Ceny s\u0105 podawane w z\u0142otych polskich i zawieraj\u0105 nale\u017cne podatki.<\/span><\/p>

5.2. Klient mo\u017ce zap\u0142aci\u0107 online za pomoc\u0105 bramki p\u0142atniczej ING Pay, \u015bwiadczonej przez ING Bank \u015al\u0105ski S.A., ul. Sokolska 34, 40-086 Katowice, KRS 0000005459, NIP 634-013-54-75, REGON 271514909.<\/span><\/p>

5.3. W Studiu mog\u0105 by\u0107 przyjmowane p\u0142atno\u015bci kart\u0105 lub BLIK za po\u015brednictwem terminala p\u0142atniczego. PLAYGROUND nie przyjmuje p\u0142atno\u015bci got\u00f3wk\u0105 ani tradycyjnym przelewem bankowym, chyba \u017ce w konkretnej ofercie wyra\u017anie wskazano inaczej.<\/span><\/p>

5.4. PLAYGROUND nie otrzymuje pe\u0142nych danych karty p\u0142atniczej Klienta. Dane niezb\u0119dne do realizacji p\u0142atno\u015bci s\u0105 przetwarzane przez operatora p\u0142atno\u015bci.<\/span><\/p>

5.5. Zakup zostaje potwierdzony w Serwisie lub w wiadomo\u015bci przes\u0142anej na adres e-mail Klienta.<\/span><\/p>

6. Karnety i Cz\u0142onkostwa<\/b><\/p>

6.1. Karnet lub Cz\u0142onkostwo jest wa\u017cne przez okres wskazany w opisie danego produktu. Niewykorzystane Wej\u015bcia wygasaj\u0105 po up\u0142ywie tego okresu i nie przechodz\u0105 na kolejny okres.<\/span><\/p>

6.2. Okres wa\u017cno\u015bci co do zasady nie podlega przed\u0142u\u017ceniu. W wyj\u0105tkowych, udokumentowanych przypadkach zdrowotnych albo gdy korzystanie z us\u0142ug zosta\u0142o istotnie ograniczone z przyczyn le\u017c\u0105cych po stronie PLAYGROUND, PLAYGROUND mo\u017ce przed\u0142u\u017cy\u0107 wa\u017cno\u015b\u0107 lub zaproponowa\u0107 inne odpowiednie rozwi\u0105zanie.<\/span><\/p>

6.3. Cz\u0142onkostwo zapewnia dost\u0119p do Zaj\u0119\u0107 obj\u0119tych danym planem, ale nie gwarantuje konkretnego instruktora, konkretnej godziny Zaj\u0119\u0107, niezmiennego tygodniowego grafiku ani miejsca na ka\u017cdej wybranej sesji.<\/span><\/p>

6.4. Rezerwacje zawsze zale\u017c\u0105 od dost\u0119pno\u015bci miejsc.<\/span><\/p>

6.5. PLAYGROUND mo\u017ce w rozs\u0105dnym zakresie zmienia\u0107 instruktor\u00f3w, formaty Zaj\u0119\u0107, grafik, godziny otwarcia oraz dost\u0119pno\u015b\u0107 Zaj\u0119\u0107. Istotne zmiany nie mog\u0105 pozbawia\u0107 Klienta zasadniczej warto\u015bci zakupionego Karnetu lub Cz\u0142onkostwa.<\/span><\/p>

7. Founding Membership<\/b><\/p>

7.1. Oferta Founding Membership jest limitowana do pierwszych 50 uprawnionych os\u00f3b. Miejsce zostaje zabezpieczone po uko\u0144czeniu procesu zakupu, zaksi\u0119gowaniu pierwszej skutecznej p\u0142atno\u015bci, zaakceptowaniu wymaganych zg\u00f3d.<\/span><\/p>

7.2. Cena Founding Membership mo\u017ce pozosta\u0107 niezmieniona maksymalnie przez 12 kolejnych miesi\u0119cy cz\u0142onkostwa, pod warunkiem zachowania jego ci\u0105g\u0142o\u015bci i terminowego regulowania p\u0142atno\u015bci.<\/span><\/p>

7.3. Founding Membership nie oznacza obowi\u0105zku zawarcia umowy na 12 miesi\u0119cy.<\/span><\/p>

7.4. Niewykorzystane Wej\u015bcia nie przechodz\u0105 na kolejny miesi\u0119czny okres rozliczeniowy.<\/span><\/p>

7.5. Po zako\u0144czeniu Founding Membership Klient traci cen\u0119 i miejsce w ofercie za\u0142o\u017cycielskiej. Ponowne przyst\u0105pienie nast\u0119puje wed\u0142ug cen i ofert dost\u0119pnych w danym momencie.<\/span><\/p>

8. Rezerwacje, anulowanie i sp\u00f3\u017anienia<\/b><\/p>

8.1. Rezerwacji i anulowania Zaj\u0119\u0107 dokonuje si\u0119 za po\u015brednictwem systemu Fitssey.<\/span><\/p>

8.2. Klient mo\u017ce anulowa\u0107 rezerwacj\u0119 bez utraty Wej\u015bcia najp\u00f3\u017aniej 12 godzin przed planowanym rozpocz\u0119ciem Zaj\u0119\u0107.<\/span><\/p>

8.3. Anulowanie dokonane p\u00f3\u017aniej ni\u017c 12 godzin przed rozpocz\u0119ciem Zaj\u0119\u0107 oraz nieobecno\u015b\u0107 bez anulowania s\u0105 traktowane jako p\u00f3\u017ane anulowanie lub nieobecno\u015b\u0107. W takim przypadku odpowiednie Wej\u015bcie uznaje si\u0119 za wykorzystane.<\/span><\/p>

8.4. Wej\u015bcie po rozpocz\u0119ciu Zaj\u0119\u0107 mo\u017ce nie zosta\u0107 dopuszczone, poniewa\u017c rozgrzewka i instrukcje bezpiecze\u0144stwa mog\u0142y ju\u017c si\u0119 zako\u0144czy\u0107, sp\u00f3\u017anienie mo\u017ce zak\u0142\u00f3ci\u0107 Zaj\u0119cia, a instruktor mo\u017ce nie mie\u0107 mo\u017cliwo\u015bci bezpiecznego wprowadzenia Klienta do korzystania ze sprz\u0119tu.<\/span><\/p>

8.5. Klient, kt\u00f3ry nie mo\u017ce uczestniczy\u0107 z powodu sp\u00f3\u017anienia, jest traktowany jako nieobecny, a odpowiednie Wej\u015bcie uznaje si\u0119 za wykorzystane.<\/span><\/p>

9. Zmiany i odwo\u0142anie Zaj\u0119\u0107 przez PLAYGROUND<\/b><\/p>

9.1. PLAYGROUND mo\u017ce zmieni\u0107 instruktora albo odwo\u0142a\u0107 Zaj\u0119cia z przyczyn organizacyjnych, technicznych lub losowych, w tym z powodu choroby lub niedost\u0119pno\u015bci instruktora, awarii uniemo\u017cliwiaj\u0105cej bezpieczne przeprowadzenie Zaj\u0119\u0107 albo dzia\u0142ania si\u0142y wy\u017cszej.<\/span><\/p>

9.2. W przypadku odwo\u0142ania Zaj\u0119\u0107 przez PLAYGROUND wykorzystane Wej\u015bcie zostanie zwr\u00f3cone na konto Klienta. Je\u017celi b\u0119dzie to potrzebne do umo\u017cliwienia wykorzystania zwr\u00f3conego Wej\u015bcia, okres wa\u017cno\u015bci Karnetu lub Cz\u0142onkostwa zostanie odpowiednio przed\u0142u\u017cony.<\/span><\/p>

9.3. Informacja o odwo\u0142aniu albo istotnej zmianie zostanie przekazana za po\u015brednictwem Fitssey, poczty elektronicznej lub wiadomo\u015bci SMS, o ile dane kontaktowe Klienta s\u0105 dost\u0119pne.<\/span><\/p>

10. Zdrowie i bezpiecze\u0144stwo<\/b><\/p>

10.1. Zaj\u0119cia maj\u0105 charakter rekreacyjny i nie zast\u0119puj\u0105 konsultacji lekarskiej, diagnozy ani leczenia.<\/span><\/p>

10.2. Przed rozpocz\u0119ciem Zaj\u0119\u0107 Klient powinien poinformowa\u0107 instruktora o urazach, ci\u0105\u017cy, chorobach, ograniczeniach ruchowych lub innych okoliczno\u015bciach, kt\u00f3re mog\u0105 wp\u0142ywa\u0107 na bezpieczny udzia\u0142 w \u0107wiczeniach.<\/span><\/p>

10.3. Je\u017celi Klient ma w\u0105tpliwo\u015bci dotycz\u0105ce zdolno\u015bci do udzia\u0142u w Zaj\u0119ciach, powinien wcze\u015bniej skonsultowa\u0107 si\u0119 z lekarzem lub innym w\u0142a\u015bciwym specjalist\u0105.<\/span><\/p>

10.4. Klient jest zobowi\u0105zany wykonywa\u0107 polecenia instruktora dotycz\u0105ce prawid\u0142owego i bezpiecznego korzystania ze sprz\u0119tu oraz niezw\u0142ocznie zg\u0142osi\u0107 b\u00f3l, zawroty g\u0142owy, duszno\u015b\u0107, os\u0142abienie albo inne niepokoj\u0105ce objawy.<\/span><\/p>

10.5. Instruktor mo\u017ce zmodyfikowa\u0107 \u0107wiczenie, przerwa\u0107 udzia\u0142 Klienta albo odm\u00f3wi\u0107 dopuszczenia go do Zaj\u0119\u0107, je\u017celi jest to uzasadnione wzgl\u0119dami bezpiecze\u0144stwa.<\/span><\/p>

10.6. Podczas Zaj\u0119\u0107 obowi\u0105zuj\u0105 czyste skarpetki antypo\u015blizgowe. Klient powinien przynie\u015b\u0107 w\u0142asne skarpetki. Skarpetki mog\u0105 by\u0107 dost\u0119pne do zakupu stacjonarnie w Studiu, zale\u017cnie od aktualnej dost\u0119pno\u015bci, jednak PLAYGROUND nie gwarantuje ich dost\u0119pno\u015bci.<\/span><\/p>

11. Zasady zachowania w Studiu<\/b><\/p>

11.1. Klienci s\u0105 zobowi\u0105zani zachowywa\u0107 si\u0119 w spos\u00f3b bezpieczny i z szacunkiem wobec innych uczestnik\u00f3w, instruktor\u00f3w oraz personelu PLAYGROUND.<\/span><\/p>

11.2. Niedopuszczalne s\u0105 zachowania agresywne, obra\u017aliwe, dyskryminuj\u0105ce, zagra\u017caj\u0105ce bezpiecze\u0144stwu lub istotnie zak\u0142\u00f3caj\u0105ce przebieg Zaj\u0119\u0107.<\/span><\/p>

11.3. W Zaj\u0119ciach nie mog\u0105 uczestniczy\u0107 osoby znajduj\u0105ce si\u0119 pod wp\u0142ywem alkoholu, \u015brodk\u00f3w odurzaj\u0105cych lub innych substancji wp\u0142ywaj\u0105cych na zdolno\u015b\u0107 bezpiecznego wykonywania \u0107wicze\u0144.<\/span><\/p>

11.4. Instruktor lub personel PLAYGROUND mo\u017ce odm\u00f3wi\u0107 udzia\u0142u w Zaj\u0119ciach albo poprosi\u0107 Klienta o opuszczenie Studia, je\u017celi jego zachowanie lub stan stwarza zagro\u017cenie, zak\u0142\u00f3ca Zaj\u0119cia albo narusza Regulamin.<\/span><\/p>

11.5. Je\u017celi odmowa udzia\u0142u lub usuni\u0119cie z Zaj\u0119\u0107 nast\u0119puje z przyczyn le\u017c\u0105cych po stronie Klienta, odpowiednie Wej\u015bcie uznaje si\u0119 za wykorzystane.<\/span><\/p>

12. Rzeczy osobiste i wyposa\u017cenie<\/b><\/p>

12.1. Klienci powinni pozostawia\u0107 rzeczy osobiste w miejscach do tego przeznaczonych i nie wnosi\u0107 warto\u015bciowych przedmiot\u00f3w na sal\u0119 Zaj\u0119\u0107.<\/span><\/p>

12.2. PLAYGROUND nie ponosi odpowiedzialno\u015bci za utrat\u0119, zniszczenie lub uszkodzenie rzeczy pozostawionych bez odpowiedniego zabezpieczenia, z wyj\u0105tkiem sytuacji, w kt\u00f3rych odpowiedzialno\u015bci tej nie mo\u017cna wy\u0142\u0105czy\u0107 na podstawie obowi\u0105zuj\u0105cych przepis\u00f3w prawa.<\/span><\/p>

12.3. Znalezione przedmioty b\u0119d\u0105 przechowywane przez 30 dni. Po tym terminie PLAYGROUND post\u0105pi z nimi zgodnie z obowi\u0105zuj\u0105cymi przepisami.<\/span><\/p>

12.4. Klient ponosi na zasadach og\u00f3lnych odpowiedzialno\u015b\u0107 za szkody w wyposa\u017ceniu Studia spowodowane jego zawinionym dzia\u0142aniem lub korzystaniem z wyposa\u017cenia niezgodnie z instrukcjami personelu.<\/span><\/p>

13. Fotografowanie i nagrywanie<\/strong><\/p>

13.1. Klient nie mo\u017ce fotografowa\u0107 ani nagrywa\u0107 innych uczestnik\u00f3w Zaj\u0119\u0107 bez ich uprzedniej zgody.<\/span><\/p>

13.2. Wykonywanie przez PLAYGROUND zdj\u0119\u0107 lub nagra\u0144, na kt\u00f3rych mo\u017cliwe jest rozpoznanie Klienta, oraz wykorzystywanie ich w celach promocyjnych wymaga odr\u0119bnej zgody Klienta.<\/span><\/p>

13.3. Brak zgody na wykorzystanie wizerunku nie wp\u0142ywa na mo\u017cliwo\u015b\u0107 korzystania z us\u0142ug PLAYGROUND.<\/span><\/p>

14. Reklamacje<\/b><\/p>

14.1. Klient mo\u017ce z\u0142o\u017cy\u0107 reklamacj\u0119 dotycz\u0105c\u0105 funkcjonowania Serwisu, p\u0142atno\u015bci, zakupionego Karnetu lub Cz\u0142onkostwa albo sposobu wykonania us\u0142ug przez PLAYGROUND.<\/span><\/p>

14.2. Reklamacj\u0119 nale\u017cy przes\u0142a\u0107 drog\u0105 elektroniczn\u0105 na adres: hello@playground-wellness.com.<\/span><\/p>

14.3. Reklamacja powinna, w miar\u0119 mo\u017cliwo\u015bci, zawiera\u0107:<\/span><\/p>

a. imi\u0119 i nazwisko Klienta;<\/p>

b. adres e-mail przypisany do konta Fitssey;<\/p>

c. opis zg\u0142aszanych nieprawid\u0142owo\u015bci;<\/p>

d. dat\u0119 zdarzenia, Zaj\u0119\u0107, zakupu lub transakcji, kt\u00f3rej dotyczy reklamacja;<\/p>

e oczekiwany spos\u00f3b rozwi\u0105zania sprawy; oraz<\/p>

f. dokumenty lub informacje umo\u017cliwiaj\u0105ce ustalenie okoliczno\u015bci sprawy, je\u017celi s\u0105 dost\u0119pne.<\/p>

14.4. Brak kt\u00f3rejkolwiek z powy\u017cszych informacji nie powoduje automatycznego odrzucenia reklamacji. Je\u017celi przekazane informacje nie b\u0119d\u0105 wystarczaj\u0105ce do jej rozpatrzenia, PLAYGROUND mo\u017ce poprosi\u0107 Klienta o ich uzupe\u0142nienie.<\/span><\/p>

14.5. PLAYGROUND rozpatrzy reklamacj\u0119 i udzieli odpowiedzi w terminie 14 dni od dnia jej otrzymania. Odpowied\u017a zostanie przes\u0142ana na adres e-mail Klienta, chyba \u017ce Klient wska\u017ce inn\u0105 form\u0119 odpowiedzi na trwa\u0142ym no\u015bniku.<\/span><\/p>

14.6. Konsument oraz Przedsi\u0119biorca na prawach konsumenta mog\u0105 korzysta\u0107 z uprawnie\u0144 przys\u0142uguj\u0105cych im na podstawie bezwzgl\u0119dnie obowi\u0105zuj\u0105cych przepis\u00f3w prawa. Przedsi\u0119biorca na prawach konsumenta mo\u017ce sk\u0142ada\u0107 reklamacje na takich samych zasadach proceduralnych jak Konsument, w zakresie, w jakim przepisy prawa przyznaj\u0105 mu ochron\u0119 konsumenck\u0105.<\/span><\/p>

14.7. Z\u0142o\u017cenie reklamacji nie ogranicza prawa Konsumenta ani Przedsi\u0119biorcy na prawach konsumenta do dochodzenia roszcze\u0144 na podstawie obowi\u0105zuj\u0105cych przepis\u00f3w prawa.<\/span><\/p>

15. Prawo konsumenta do odst\u0105pienia od umowy zawartej na odleg\u0142o\u015b\u0107<\/strong><\/p>

15.1. Klient b\u0119d\u0105cy konsumentem, kt\u00f3ry zawar\u0142 umow\u0119 na odleg\u0142o\u015b\u0107 za po\u015brednictwem Serwisu, mo\u017ce odst\u0105pi\u0107 od niej w terminie 14 dni od dnia zawarcia umowy, bez podawania przyczyny oraz, z zastrze\u017ceniem ust. 5 poni\u017cej, bez ponoszenia koszt\u00f3w.<\/span><\/p>

15.2. W celu skorzystania z prawa odst\u0105pienia Klient powinien poinformowa\u0107 PLAYGROUND o swojej decyzji w drodze jednoznacznego o\u015bwiadczenia przes\u0142anego na adres e-mail: hello@playground-wellness.com. Klient mo\u017ce skorzysta\u0107 z ustawowego wzoru formularza odst\u0105pienia od umowy, jednak nie jest to obowi\u0105zkowe.<\/span><\/p>

15.3. Do zachowania terminu wystarczy przes\u0142anie o\u015bwiadczenia o odst\u0105pieniu przed up\u0142ywem 14-dniowego terminu.<\/span><\/p>

15.4. W przypadku skutecznego odst\u0105pienia od umowy PLAYGROUND zwr\u00f3ci Klientowi nale\u017cne p\u0142atno\u015bci niezw\u0142ocznie, nie p\u00f3\u017aniej ni\u017c w terminie 14 dni od dnia otrzymania o\u015bwiadczenia o odst\u0105pieniu. Zwrot zostanie dokonany przy u\u017cyciu takiego samego sposobu p\u0142atno\u015bci, jakiego u\u017cy\u0142 Klient, chyba \u017ce Klient wyra\u017anie zgodzi si\u0119 na inny spos\u00f3b, kt\u00f3ry nie wi\u0105\u017ce si\u0119 dla niego z dodatkowymi kosztami.<\/span><\/p>

15.5. Je\u017celi na wyra\u017ane \u017c\u0105danie Klienta \u015bwiadczenie us\u0142ug rozpocz\u0119\u0142o si\u0119 przed up\u0142ywem 14-dniowego terminu na odst\u0105pienie od umowy, Klient, kt\u00f3ry nast\u0119pnie odst\u0105pi od umowy, jest zobowi\u0105zany zap\u0142aci\u0107 za \u015bwiadczenia spe\u0142nione do chwili poinformowania PLAYGROUND o odst\u0105pieniu. Nale\u017cna kwota zostanie obliczona proporcjonalnie do zakresu wykorzystanych us\u0142ug i ceny zakupionego Planu.<\/span><\/p>

15.6. Prawo odst\u0105pienia od umowy o \u015bwiadczenie us\u0142ug wygasa po pe\u0142nym wykonaniu us\u0142ugi, je\u017celi jej realizacja rozpocz\u0119\u0142a si\u0119 za uprzedni\u0105, wyra\u017an\u0105 zgod\u0105 Klienta, kt\u00f3ry przed rozpocz\u0119ciem \u015bwiadczenia zosta\u0142 poinformowany i przyj\u0105\u0142 do wiadomo\u015bci, \u017ce po pe\u0142nym wykonaniu us\u0142ugi utraci prawo odst\u0105pienia od umowy.<\/span><\/p>

16. Pozas\u0105dowe rozwi\u0105zywanie spor\u00f3w<\/b><\/p>

16.1. Klient b\u0119d\u0105cy konsumentem mo\u017ce skorzysta\u0107 z pozas\u0105dowych sposob\u00f3w rozpatrywania reklamacji i dochodzenia roszcze\u0144. Informacje o dost\u0119pnych procedurach znajduj\u0105 si\u0119 na stronie polubowne.uokik.gov.pl.<\/span><\/p>

17. Postanowienia ko\u0144cowe<\/b><\/p>

17.1. Dokonanie zakupu wymaga akceptacji Regulaminu.<\/span><\/p>

17.2. PLAYGROUND mo\u017ce zmieni\u0107 Regulamin w szczeg\u00f3lno\u015bci w przypadku zmiany przepis\u00f3w prawa, zakresu lub sposobu \u015bwiadczenia us\u0142ug, wprowadzenia nowych us\u0142ug, zmiany wykorzystywanego systemu rezerwacji lub metod p\u0142atno\u015bci albo konieczno\u015bci zapewnienia bezpiecze\u0144stwa Klient\u00f3w lub prawid\u0142owego funkcjonowania Studia.<\/span><\/p>

17.3. Informacja o zmianie Regulaminu zostanie opublikowana w Serwisie. Je\u017celi zmiana dotyczy Klient\u00f3w posiadaj\u0105cych aktywne konto lub trwaj\u0105ce Cz\u0142onkostwo, informacja zostanie r\u00f3wnie\u017c przekazana na adres e-mail przypisany do konta.<\/span><\/p>

17.4. Zmiany Regulaminu nie naruszaj\u0105 praw nabytych przed dat\u0105 ich wej\u015bcia w \u017cycie. Do jednorazowych us\u0142ug i Karnet\u00f3w zakupionych przed zmian\u0105 stosuje si\u0119 wersj\u0119 Regulaminu obowi\u0105zuj\u0105c\u0105 w chwili zakupu, chyba \u017ce zmiana wynika z bezwzgl\u0119dnie obowi\u0105zuj\u0105cych przepis\u00f3w prawa.<\/span><\/p>

17.5. W sprawach nieuregulowanych Regulaminem zastosowanie maj\u0105 przepisy prawa polskiego, w szczeg\u00f3lno\u015bci Kodeksu cywilnego oraz ustawy o prawach konsumenta.<\/span><\/p>

Terms and Conditions of PLAYGROUND Services<\/b><\/p>

23 September 2026<\/span><\/p>

1. General provisions<\/b><\/p>

1.1. These Terms and Conditions set out the rules for using PLAYGROUND services, including creating an account, purchasing Class Packs and Memberships, making bookings and participating in Classes held at the Studio.<\/span><\/p>

1.2. The services are provided by Playground Wellness Sp. z o.o. under the name PLAYGROUND Reformer Pilates Studio.<\/span><\/p>

1.3. These Terms and Conditions are made available free of charge through the Service in a form that allows them to be saved and reproduced. Clients should read them before making a purchase or booking.<\/span><\/p>

1.4. An online contract is concluded when the Client selects a service, completes the required payment and receives confirmation of the purchase through the Service.<\/span><\/p>

2. Service provider details<\/strong><\/p>

2.1. The service provider and operator of the Service is Playground Wellness Sp. z o.o., with its registered office at ul. Kr\u00f3lowej Jadwigi 30\/2, 42-500 B\u0119dzin, Poland, tax identification number NIP 6252507492, statistical number REGON 545101578 and National Court Register number KRS 0001250405.<\/span><\/p>

2.2. The company is entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Katowice-Wsch\u00f3d in Katowice, 8th Commercial Division of the National Court Register.<\/span><\/p>

2.3. The PLAYGROUND Studio is located at ul. Pa\u0144ska 96\/lok. 208, 00-837 Warsaw, Poland.<\/span><\/p>

2.4. PLAYGROUND can be contacted by email at hello@playground-wellness.com.<\/span><\/p>

2.5. The Company\u2019s share capital is PLN 5,000.00.<\/span><\/p>

3. Definitions<\/b><\/p>

Term<\/b>: Meaning<\/span><\/p>

Playground<\/b>: Playground Wellness Sp. z o.o., providing services under the name PLAYGROUND Reformer Pilates Studio.<\/span><\/p>

Studio<\/b>: the PLAYGROUND premises at ul. Pa\u0144ska 96\/lok. 208 in Warsaw.<\/span><\/p>

Service: <\/b>the PLAYGROUND website and the Fitssey system used for sales, Client accounts and bookings.<\/span><\/p>

Client: <\/b>a person using the Service or PLAYGROUND services.<\/span><\/p>

Class:<\/b> a group or individual movement session offered by PLAYGROUND.<\/span><\/p>

Class Pack: a purchased package containing a specified number of Class Credits, valid for the period stated in its description.<\/span><\/p>

Membership: <\/b>a service providing access to a specified number or category of Classes under the rules stated in the relevant plan description.<\/span><\/p>

Class Credit:<\/b> one entitlement to attend a Class, deducted from a Class Pack or Membership.<\/span><\/p>

4. Account and use of the Service<\/b><\/p>

4. 1. Booking Classes and using Class Packs or Memberships may require the creation of an individual account in Fitssey.<\/span><\/p>

4. <\/span>2. Clients must provide true, complete and current information and protect their account login details against access by third parties.<\/p>

4. 3. The account, Class Pack, Membership and bookings are personal. They may not be shared, transferred, resold or used by another person unless PLAYGROUND expressly states otherwise in the description of a particular offer.<\/span><\/p>

4. 4. Bookings may be made only for the account holder.<\/span><\/p>

5. Purchases and payments<\/b><\/p>

5.1. Current services, prices, validity periods and numbers of Class Credits are displayed through the Service. Prices are stated in Polish z\u0142oty and include applicable taxes.<\/span><\/p>

5.2. Clients may pay online using the ING Pay payment gateway provided by ING Bank \u015al\u0105ski S.A., ul. Sokolska 34, 40-086 Katowice, KRS 0000005459, NIP 634-013-54-75 and REGON 271514909.<\/span><\/p>

5.3. Card and BLIK payments may be accepted at the Studio through a payment terminal. PLAYGROUND does not accept cash or traditional bank transfers unless expressly stated otherwise for a particular offer.<\/span><\/p>

5.4. PLAYGROUND does not receive the Client\u2019s complete payment card details. Payment information required to process a transaction is handled by the payment provider.<\/span><\/p>

5.5. A purchase is confirmed through the Service or by a message sent to the Client\u2019s email address.<\/span><\/p>

6. Class Packs and Memberships<\/b><\/p>

6.1. A Class Pack or Membership is valid for the period stated in the relevant product description. Unused Class Credits expire at the end of that period and do not carry over to a subsequent period.<\/span><\/p>

6.2. Validity periods are not normally extended. In exceptional, documented health-related circumstances, or where access to services has been materially restricted for reasons attributable to PLAYGROUND, PLAYGROUND may extend the validity period or offer another appropriate solution.<\/span><\/p>

6.3. Membership provides access to eligible Classes but does not guarantee a specific instructor, a specific Class time, a fixed weekly timetable or availability in every requested session.<\/span><\/p>

6.4. Bookings are always subject to availability.<\/span><\/p>

6.5. PLAYGROUND may reasonably change instructors, Class formats, the timetable, opening hours and Class availability. Material changes will not deprive the Client of the essential value of the purchased Class Pack or Membership.<\/span><\/p>

7. Founding Membership<\/b><\/p>

7.1. The Founding Membership offer is limited to the first 50 eligible Clients. A place is secured after the purchase process has been completed, the first payment has been successfully processed, all required consents have been accepted and PLAYGROUND has issued confirmation.<\/span><\/p>

7.2. The Founding Membership rate may remain fixed for up to 12 consecutive months of Membership, provided that the Membership remains continuous and payments are made on time.<\/span><\/p>

7.3. Founding Membership does not require a 12-month minimum commitment.<\/span><\/p>

7.4. Unused Class Credits do not carry over to the next monthly billing period.<\/span><\/p>

7.5. When Founding Membership ends, the Client loses the founding rate and place. Any later rejoining will be subject to the prices and offers available at that time.<\/span><\/p>

8. Bookings, cancellations and late arrival<\/b><\/p>

8.1. Classes must be booked and cancelled through Fitssey.<\/span><\/p>

8.2. A Client may cancel a booking without losing the relevant Class Credit no later than 12 hours before the scheduled start of the Class.<\/span><\/p>

8.3. A cancellation made less than 12 hours before the Class and a failure to attend without cancellation are treated as a late cancellation or no-show. The applicable Class Credit will be treated as used.<\/span><\/p>

8.4. Entry after the Class has started may not be permitted because the warm-up and safety instructions may already have been completed, late entry may disrupt other Clients, and the instructor may no longer be able to provide a safe introduction to the equipment.<\/span><\/p>

8.5. A Client who cannot participate because of late arrival will be treated as a no-show, and the applicable Class Credit will be treated as used.<\/span><\/p>

9. Changes and cancellations by PLAYGROUND<\/b><\/p>

9.1. PLAYGROUND may change the instructor or cancel a Class for organisational, technical or unforeseen reasons, including instructor illness or unavailability, a failure preventing the Class from being conducted safely, or force majeure.<\/span><\/p>

9.2. If PLAYGROUND cancels a Class, the relevant Class Credit will be returned to the Client\u2019s account. Where necessary to allow the returned Class Credit to be used, the validity of the Class Pack or Membership will be extended accordingly.<\/span><\/p>

9.3. Notice of a cancellation or material change will be provided through Fitssey, email or SMS, where the Client\u2019s contact details are available.<\/span><\/p>

10. Health and safety<\/b><\/p>

10.1. Classes are recreational and do not replace medical advice, diagnosis or treatment.<\/span><\/p>

10.2. Before a Class, Clients should inform the instructor about injuries, pregnancy, medical conditions, movement limitations or any other circumstances that may affect safe participation.<\/span><\/p>

10.3. Clients who are unsure whether they can safely participate should consult a doctor or other appropriate healthcare professional in advance.<\/span><\/p>

10.4. Clients must follow the instructor\u2019s directions on the correct and safe use of equipment and immediately report pain, dizziness, shortness of breath, weakness or any other concerning symptoms.<\/span><\/p>

10.5. The instructor may modify an exercise, stop a Client\u2019s participation or refuse participation where reasonably necessary for safety.<\/span><\/p>

10.6. Clean non-slip socks are mandatory during Classes. Clients should bring their own. Socks may be available to purchase at the Studio subject to stock, but PLAYGROUND does not guarantee availability.<\/span><\/p>

11. Conduct at the Studio<\/b><\/p>

11.1. Clients must behave safely and respectfully towards other Clients, instructors and PLAYGROUND staff.<\/span><\/p>

11.2. Aggressive, abusive, discriminatory or unsafe conduct, and conduct that materially disrupts a Class, is not permitted.<\/span><\/p>

11.3. A person under the influence of alcohol, drugs or any other substance affecting their ability to exercise safely may not participate in a Class.<\/span><\/p>

11.4. An instructor or member of PLAYGROUND staff may refuse participation or require a Client to leave the Studio where the Client\u2019s condition or conduct creates a risk, disrupts a Class or breaches these Terms and Conditions.<\/span><\/p>

11.5. Where participation is refused or a Client is removed for reasons attributable to that Client, the relevant Class Credit will be treated as used.<\/span><\/p>

12. Personal belongings and Studio equipment<\/b><\/p>

12.1. Clients should leave personal belongings in the designated areas and should not bring valuable items into the Class area.<\/span><\/p>

12.2. PLAYGROUND is not liable for the loss of or damage to belongings left without appropriate security, except where such liability cannot be excluded under applicable law.<\/span><\/p>

12.3. Lost property will be kept for 30 days. After that period, PLAYGROUND will handle it in accordance with applicable law.<\/span><\/p>

12.4. A Client is liable under the general rules of law for damage to Studio equipment caused by their fault or by using equipment contrary to staff instructions.<\/span><\/p>

13. Photography and recording<\/strong><\/p>

13.1. A Client may not photograph or record other Class participants without their prior consent.<\/span><\/p>

13.2. PLAYGROUND requires the Client\u2019s separate consent before taking or using promotional photographs or recordings in which the Client can be identified.<\/span><\/p>

13.3. Refusing consent to the use of a Client\u2019s image does not affect their ability to use PLAYGROUND services.<\/span><\/p>

14. Complaints<\/b><\/p>

14.1. A Client may submit a complaint concerning the operation of the Service, a payment, a purchased Class Pack or Membership, or the manner in which PLAYGROUND services have been provided.<\/span><\/p>

14.2. Complaints should be submitted by email to hello@playground-wellness.com.<\/span><\/p>

\u00a0<\/p>

14.3 Where possible, a complaint should include:<\/span><\/p>

a. the Client\u2019s full name;<\/p>

b. the email address connected to the Client\u2019s Fitssey account;<\/p>

c. a description of the reported issue;<\/p>

d. the date of the relevant event, Class, purchase or transaction;<\/p>

e. the requested resolution; and<\/p>

f. any documents or information that may assist in reviewing the complaint, where available.<\/p>

14.4 The absence of any of the information listed above will not automatically result in the complaint being rejected. If the information provided is insufficient, PLAYGROUND may ask the Client to provide additional information.<\/span><\/p>

14.5. PLAYGROUND will review the complaint and respond within 14 days after receiving it. The response will be sent to the Client\u2019s email address unless the Client requests another durable form of communication.<\/span><\/p>

14.6 Consumers and Entrepreneurs with Consumer Rights may exercise the rights granted to them under mandatory provisions of applicable law. An Entrepreneur with Consumer Rights may submit complaints under the same procedural rules as a Consumer to the extent that applicable law grants that person consumer protection.<\/span><\/p>

14.7 Submitting a complaint does not limit the right of a Consumer or an Entrepreneur with Consumer Rights to pursue claims under applicable law.<\/span><\/p>

15. Consumer\u2019s right to withdraw from a distance contract<\/b><\/p>

15.1. A Client who is a consumer and enters into a distance contract through the Service may withdraw from the contract within 14 days from the date on which it was concluded, without giving any reason and, subject to paragraph 5 below, without incurring any costs.<\/span><\/p>

15.2. To exercise the right of withdrawal, the Client must inform PLAYGROUND of the decision by sending an unequivocal statement to hello@playground-wellness.com. The Client may use the statutory model withdrawal form, but its use is not mandatory.<\/span><\/p>

15.3. The withdrawal deadline is met if the Client sends the withdrawal statement before the end of the 14-day period.<\/span><\/p>

15.4. Following an effective withdrawal, PLAYGROUND will refund all payments due to the Client without undue delay and no later than 14 days after receiving the withdrawal statement. The refund will be made using the same payment method originally used by the Client, unless the Client expressly agrees to another method that does not result in any additional costs.<\/span><\/p>

15.5. If the provision of services began before the end of the 14-day withdrawal period at the Client\u2019s express request, a Client who subsequently withdraws from the contract must pay for the services provided up to the time when PLAYGROUND was informed of the withdrawal. The amount due will be calculated in proportion to the services used and the price of the purchased Plan.<\/span><\/p>

15.6. The right to withdraw from a service contract expires once the service has been fully performed, provided that performance began with the Client\u2019s prior express consent and after the Client had been informed and acknowledged that the right of withdrawal would be lost once the service had been fully performed.<\/span><\/p>

16. Alternative dispute resolution<\/b><\/p>

16.1. A Client who is a consumer may use out-of-court procedures for handling complaints and pursuing claims. Information about available procedures can be found at polubowne.uokik.gov.pl.<\/span><\/p>

17. Final provisions<\/b><\/p>

17.1. A purchase requires acceptance of these Terms and Conditions.<\/span><\/p>

17.2. PLAYGROUND may amend these Terms and Conditions in particular due to changes in law, the scope or method of providing services, the introduction of new services, changes to the booking system or payment methods, or the need to ensure Client safety or the proper operation of the Studio.<\/span><\/p>

17.3. Notice of an amendment will be published through the Service. If an amendment affects Clients with an active account or ongoing Membership, notice will also be sent to the email address connected to the account.<\/span><\/p>

17.4. Amendments do not affect rights acquired before their effective date. One-off services and Class Packs purchased before an amendment remain subject to the version accepted at the time of purchase, unless a change is required by mandatory law.<\/span><\/p>

17.5. Matters not covered by these Terms and Conditions are governed by Polish law, including the Polish Civil Code and the Polish Consumer Rights Act.<\/span><\/p>
